Eh, that's like claiming the 'Insanity' defense. At the worst, he'll be locked up in a padded room, stripped of his Ninja status, and never, ever, allowed out of his padded room. The Seal can't be removed, as far as we know, so he'll always be locked away.

Unlike Anko, who left Orochimaru when she discovered what he was doing, Sasuke left the Leaf knowing full well who it was that killed Sarutobi and attempted to destroy the Leaf.

Now, as you say, the Sharingan bloodline is valuable indeed. I wouldn't be surprised if they effectively rape Sasuke over and over again until they have a nice supply of knocked up women to carry on the bloodline.

Aside from that, even the Council can't give him a 'Get out of jail free card' and make everything nice and dandy. They don't really have that kind of political power, at least from my perspective. They deal with the day to day operations of the Leaf, things like allocating funds to build things/pay contractors, and general civilian things (As well as clan politics). Think of them like Congress.

The Hokage and the Shinobi are a seperate entity from the Council. They deal with military affairs and the like. Think of the Hokage as the President and the 5 Star General all rolled into one. Simply put, Sasuke betrayed his sworn duty to the Leaf, violated their trust, and nearly caused the deaths of young promising Shinobi in his mad quest for power.

He's, simply put, a Traitor. The Hokage can hold a Military Tribunal of sorts, which the Council (Congress) can't do shit to interfer with, as it's beyond their juristriction. Of course they could try to put pressure on the Hokage for a 'lenient' sentence, but that is a very suspect phrase which the Hokage could interpret any damn way he/she wanted.

Gouge out his eyes, cut off his arms and legs, and make him the Uchiha Baby Making Machine until he dies? Beats being fucking killed right on the spot, doesn't it? That's lienency.

Very true, and they have already revealed a subplot about how an ANBU member is trying to gather his strength for a possible coup of his own. I wouldn't be surprised if they used this angle, and said he had convinced Sasuke to do it for the village, and that he could return as a hero, plus get the training he needs to kill Itachi.

Sasuke's last scene with Sakura would support that he believed what he was doing was for the best. Otherwise, he might have let her come with him.

You give Kishimoto too much credit, I can see somebody (new! Sakura, Tsunade or Jiraiya anyone?) finding out how to remove the curse seal Sarutobi struggled with for a billion years! Or Kishi-chan might even make Orochimaru have to remove it before e takes a body! Or last, it'll somehow disappear when they kill him and Sasuke will be all horrified with what he did.

Come on, you KNOW you can see it happening.

You might be ignoring the fact that while Danzou sent Sai to forge an alliance with Orochimaru he also sent Sai to kill Sasuke.

Sasuke is going to die! The question is how. Will he sacrifice himself to save Naruto, Sakura, what? Will he do it to defeat Orochimaru, Itachi, or a whole different type of enemy?

My bet. He sacrifices himself to take down Orochimaru to save Naruto or Sakura. Most likely Naruto so he can tell Naruto to take down Itachi for him.

Most likely scenarios:

Danzou will have been involved with a sect of Uchiha elders, who had planned to use the Kyuubi no Yoko to gain control over Konoha. It failed, and the Fox, seeing their headbands, decided to destroy the village for some reason.

Itachi was told certain things by his best friend, who was part of this group, which would explain why his emotional state started to shift before the slaughter. Itachi wanted no part, but his friend couldn't leave it at that, so Itachi kills him. He then goes to the secret meeting place, and discovers how many Uchiha are involved. The shock sends him slightly nuts, and he kills all.

Danzou spoke to Sasuke, knowing that Orochimaru wants him. May have offered the Forbidden Scroll as payment if he spied on Orochimaru and learned of ways to defeat him. Unknown if he sent Sai because he needed to fortify Sasuke's supposed betrayal, or believes he no longer needs Sasuke.

After a somewhat grand battle against Orochimaru, Sasuke will reveal what occurred, and be accepted back in the village. Danzou will go into hiding.

Danzou may make a deal with either Akatsuki or Orochimaru in order to try and take the Kyuubi from Naruto, in hopes of using it once more to secure the village for his own power.

Itachi and Sasuke will face off, where Itachi reveals not only why he left Sasuke alive, but why he slaughtered the Uchiha.

Beyond that is unknown.

Danzou doesn't have access to the forbidden scroll. When Naruto took it, it was in the Hokage's house, not his office. Yes, he could steal it, but he wouldn't typically have access to it.

Danzou wants to be Hokage himself, or have a puppet that he can control. He might try and use Sasuke as that puppet. Not that I think a traitor should ever be allowed to become Hokage, but some people do.

He would probably try both, he already contacted Orochimaru. If he had a way to contact Akatsuki he would. If Sai is still following his orders or is acting on his own now, could determine that. He is about to fight Akatsuki.

I see Akatsuki being taken out first, then Orochimaru. He wants to stretch the Sasuke conflict as long as possible.

It is doubtful he would trust a powerful puppet, thus that eliminates Sasuke. So he would use Sasuke to weaken the current Hokage.

Either way, Naruto is still a key he needs, and until he can find a way to get the Fox (since Akatsuki's method seals it away in the statue), he has to play both sides.

As to my Danzou/Uchiha idea, this does add some possible merit to its plausibility.

Only Kyuubi broke out, saw their headbands, and decided that yes, he needed to teach these lowly humans that payback's a bitch.

But like most vengeance plots, there was no such thing as an innocent bystander.
