Ok... I debated whether I should be putting this in the General or Love Hina section. Finally placed it here, merely because I see it in Love Hina fan fiction more than any other.

Over the years... I've seen a lot of anime based fan fiction that has the manager keeping a notebook on the tenants. That in and of itself I see no issue with. Since a manager should know the basic data (age, gender, criminal record, etc... ) and contact information on those he/she houses.

However, in many of these stories, those notes, books, files, whatever, have personal information in there on them. Things like lifestyle, hobbies, personality profiles and assessments, pitfalls of dealing with them, etc...

Is that legal in Japan? If so, is it moral?

In some ways, I would have thought it could be considered discrimination of sorts.

Thoughts?

Isn't that somewhat in canon? And is used by authors to exposit the characters as a device?

But, I'm pretty sure somthing like this is legal in japan. There's a whole industry dedicated to investigating a person's life and heritage over there.

Just look at what some people have done to ferret out burakamin.

Depends on whether anything in there is actually considered 'secret'. If it's something you'll just find out by living with them, then it's fair enough for the previous manager to hand down the information to the next. If it's something like interesting birthmark locations or something, then that crosses the line.

Things like likes and dislikes are usually pretty straightforward, after all, you don't want to take them out to celebrate at a beef bowl if one's a vegetarian, right? Things like that. In specific cases, the information might go a little too far, but it's really a case-by-case basis.

Though I don't claim to have any knowledge about the subject in Japan, I do know that here in the US, a landlord will write anything down about a tenant or prospective tenant that they find relevant, so long as finding out such info is not illegal. Anything the tenant tells you, or you find out through means that the tenant or prospective tenant would know that you'd have access to, or any information that they'd NEED, they have legal right to, I believe. I personally, I think that you should only have to know that someone is taking that info down; if you decide to put on your rental application that you are $10,000 in debt accumulated in 5 years, that's gonna go against ya... If you are one that gives only the absolutely necessary info and dont say shit else, you should legally, and morally be allowed that kind of privacy.

So... For instance, the fact that heights, weights and proportions are in the diary, I think, it's not fair game. Because even if the girls gave that to anyone, it'd change over time, and aside from it being a useless figure, there is no need to know that kind of thing.

As applies to LH, or any series really, you have to consider who exactly left the notes. In LH, it's quite likely that Hina left something in there, and, well, I don't think she cares what we or anyone else thinks.

For something like Negima, where it was Takamichi, you can expect useful information and observations only.

I can certainly see a case for special dietary habits, special needs and/or any medical conditions, but I don't see a reason for the landlord to inquire about his tenant's vital statistics and the like. It is there probably more for reader benefit than that of the landlord himself. :p

We got a necromancer. Bring out the cliche torch and pitchforks, people. Also we need to toss in some "inquisition" and "heresy" stock comments. As well as standard cries of "incompetence" because you claim it was an accident.
