I've been reading through Nymph in Servitude again and started thinking about something similar.

The basic idea is that with the hereditary issues and at least with the Old purebloods they have safeguards against a non-blood heir being given their things. This gave me a wierd idea of special enchantments that when someone outside the family is named heir, with first the heir needing to be male if there are no available direct descendants of the current line (A daughter can pass the title to their kid being able to hold the titles and such), and that the closest unmarried/betrothed is given the Metamorph talent, marking them as basically a slave/servant/whatever for the purposes of producing an heir that still has a portion of the bloodline. And since Sirius was in jail, his named heir (being Harry) was not known information and especially since the nearest male of the blood (Even though removed via the mothers marriage into an equal family (Draco from Narcissa), he would actually be lower than a named heir because he already has a family line (The Malfoys) and with the Lestranges not having any children even though they would be in the same situation if they did.

This setup is something that rarely happens, but the metamorph part was originally created to deal with a situation where a heir was named that wasn't totally human (A half-veela male named the heir of the Malfoys specifically and it was applied to the rest of the families to prevent recurring problems.)

Now add in the general magical prejudice of the magical world and stir. Add some sexist variations that they view men as better and thus while a male half-veela would be acceptable, a female wouldn't and the like. But it would partially explain Remus, he is a male Werewolf and has around the same standard rights as a normal Muggle would with the exception of Obliviation, perhaps even a muggle female.

Tonks ends up belonging to Harry for his use in the hopes that a heir would be produced with the Black blood (Meaning the first male child of the union would have the Black name and gain the title when he inherited) while leaving an opening for continuing his own family line with an actual marriage.

Other similar situations could arise from this as well, perhaps there are other rules for different creatures such as perhaps by saving Gabriel or even Fleur they end up in a similar situation, where since he saved their lives, they belong to him (Something that could also explain the half-veela's position anyway in this version of the HP-verse).

As a side note, another reason why Draco possibly couldn't qualify is that since his Aunt was the one who killed Sirius, he is exempted from inheriting anything because it qualifies as inheritance via assassination. He was related to the killer and with his mother he would stand to gain from her killing him.

I'm aiming for a much darker version of the magical world where it isn't as nice of a place as most portray it while trying to fit it into canon.
